1. Acceptance of Terms

By accessing and using Fufive ("the App", "we", "us", or "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Fufive is a voice-first English vocabulary learning application that helps users learn and practice English words through spaced repetition, AI-powered coaching, and frequency-based learning paths. The App provides features including but not limited to:

• Daily vocabulary learning (5 words per day)
• Voice-based practice and feedback
• Spaced repetition review system
• Progress tracking and analytics
• Cloud synchronization across devices

3. User Accounts

3.1 Account Creation

You may create an account using Apple Sign In. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Responsibility

You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and identification
• Accept all responsibility for any and all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. User Conduct

You agree not to:

• Use the App for any illegal purpose or in violation of any laws
• Violate or infringe upon the rights of others
• Transmit any harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to the App or its related systems
• Interfere with or disrupt the App or servers
• Use automated systems (bots, scrapers) to access the App
• Reverse engineer, decompile, or disassemble any part of the App

5. Intellectual Property

5.1 Our Rights

The App and its original content, features, and functionality are owned by Fufive and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

5.2 Your Content

You retain ownership of any content you create, input, or upload to the App (such as words, notes, and learning records). By using the App, you grant us a license to use, store, and process your content solely for the purpose of providing and improving the App's services.

6. Third-Party Services

The App uses third-party services, including but not limited to OpenAI APIs, for AI-powered features. Your use of these features may involve sharing data with third-party providers. We are not responsible for the privacy practices or content of third-party services. Please review their terms and privacy policies.

7. Service Availability

We strive to provide reliable service but do not guarantee that the App will be available at all times. The App may be unavailable due to:

• Scheduled maintenance
• Technical issues or failures
• Force majeure events
• Actions by third-party service providers

We reserve the right to modify, suspend, or discontinue any part of the App at any time with or without notice.

8. Limitation of Liability

To the maximum extent permitted by law, Fufive and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the App
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that:

• The App will meet your requirements
• The App will be uninterrupted, timely, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• Any errors in the App will be corrected

10. Indemnification

You agree to defend, indemnify, and hold harmless Fufive and its operators from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party right
• Any content you submit or transmit through the App

11. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately.

You may terminate your account at any time by deleting the App or contacting us. Upon termination, we will delete your account and data in accordance with our Privacy Policy.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the App after any revisions become effective, you agree to be bound by the revised terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Fufive operates, without regard to its conflict of law provisions.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect. These Terms constitute the entire agreement between you and Fufive regarding the App.
